EU Toy Safety: Current Checks and the 2030 Transition
EU toy safety rules are changing, but the new regulation applies from 2030. Separate current giveaway checks from future digital passport preparation.

Market: European Union | Checked: September 18, 2026 | Status: Regulatory transition (Regulation (EU) 2025/2509 in force; application from 2030)
The new Toy Safety Regulation does not yet require its toy digital product passport for current orders. Existing toy safety rules remain active, while the newly adopted framework applies in 2030. The immediate priority is establishing whether your event merchandise legally qualifies as a toy and ensuring that standard documentation matches the physical product.
Transition Timeline and Digital Product Passports
Regulation (EU) 2025/2509 entered into force on January 1, 2026, and its main product requirements, including the toy DPP, apply from August 1, 2030. Some provisions already apply from January 1, 2026, as specified in Article 59 of Regulation (EU) 2025/2509; the transition should not be read as postponing every provision. When those provisions take effect, the regulation introduces a digital product passport (DPP) system for covered toys. Throughout the intervening transition window, the established Toy Safety Directive continues to govern the European market (see the European Commission Toy Safety overview). Note that CE marking reflects a manufacturer's declaration of conformity rather than an official certificate issued by the European Union.
Determining Intended Play Value
Product classification depends on intended play function rather than distribution context alone. General event merchandise—such as ordinary youth t-shirts, branded lanyards, or standard drinkware handed out at family festivals—is not categorized as a toy solely because minors use it. Items designed or clearly intended, whether or not exclusively, for play by children under 14 require formal toy compliance.
Procurement Recommendations for Event Buyers
Check whether the item has clear play value or functions as standard merchandise, setting the target age grade before production.
Confirm that existing safety documentation, test reports, and required age warnings align with the exact model number ordered.
Separate current delivery documentation from long-term digital passport planning.
Re-check compliance records whenever promotional customizations modify base materials, coatings, or small detachable components.
