Maine PFAS rules cover specified food packaging. Check materials, intended use and the applicable exemption before choosing event catering supplies.

Market: US · Maine | Checked: September 24, 2026 | Status: In effect (Sales prohibition active since May 25, 2026)
Branded paper cups, food containers, and serving trays distributed at corporate hospitality events in Maine may fall within the state’s food-packaging chemical restrictions. The state restricts intentionally introduced PFAS above incidental presence in specified paper and plant-fiber food packaging, including promotional distribution, subject to the scope and exemption below. Event planners and marketing buyers should verify paper coatings before approving production runs.
Scope of Maine Chapter 80 Rules
Effective May 25, 2026, Maine’s Chapter 80 rule prohibits the sale and promotional distribution of specified short-term and fresh-food packaging made from paper, paperboard, or plant fiber if it contains intentionally introduced PFAS above incidental background levels. The regulation specifically covers single-use items such as beverage cups, soup bowls, plates, and takeout cartons. Title 32, Section 1733 includes an exemption specifically for the manufacturer of the food or beverage product with national annual food and beverage sales under $1 billion; confirm the responsible food or beverage manufacturer and whether it meets the stated exemption, rather than packaging vendors or entities serving the food. Program details are available at the Maine DEP Safe Chemicals in Packaging Program.
Sourcing Checklist for Event Foodware
When sourcing custom-printed foodservice items for Maine venues, consider these practical vetting steps:
Confirm direct food-contact use: Determine whether the paper goods will hold hot beverages, greasy finger foods, or fresh snacks, and confirm base paper substrates.
Ask about barrier chemistry: Inquire whether intentionally added PFAS is used in the food-contact barrier, and request the material and treatment information for the actual model.
Confirm responsible manufacturer exemption: Confirm the responsible food or beverage manufacturer and whether it meets the stated under-$1-billion exemption, rather than simply looking at the entity serving food or packaging suppliers.
Maintain model-specific supplier records: Keep material statements for specific cup and container product numbers to support assessment, keeping the PFAS assessment separate from the program’s certificate requirements for phthalates.
