Prop 65 Short-Form Warnings: What to Check Before Printing
Review Prop 65 short-form warnings before your next packaging run. Check warning decisions, manufacturing and labeling dates, and the approved artwork.

Market: California, U.S. | Checked: September 11, 2026 | Status: Revised short-form rules took effect January 1, 2025 (Transition covers products manufactured and labelled before January 1, 2028)
Before reprinting packaging or labels for promotional gifts sold in California, check which safe-harbor warning format applies to your production schedule. California Proposition 65 rules governing short-form safe-harbor warnings are in an active transition period, giving buyers time to align packaging artwork with brand directions.
Safe-Harbor Update and Transition Window
California's revised short-form safe-harbor warning regulations took effect January 1, 2025, as explained in the California OEHHA Prop 65 Business FAQ. This regulatory change is not a product ban. Under transition provisions outlined in OEHHA Compliance Assistance Materials, products manufactured and labeled before January 1, 2028 may use either the prior short-form warning or the updated version. Proposition 65 warning requirements depend on whether consumer use causes chemical exposure, not merely whether a listed substance exists in a material. Using a safe-harbor warning provides standardized language, but does not itself establish whether exposure occurs or determine overall product compliance.
The updated short-form safe-harbor content names at least one listed chemical for each endpoint covered by the warning (cancer or reproductive harm). Confirm the exact wording against the OEHHA Business FAQ and the applicable warning requirements rather than adding a chemical name to an old template without review.
Artwork and Labeling Checkpoints
Promotional merchandise often involves repeat print runs across cartons, hangtags, and catalog pages. When preparing artwork, buyers can coordinate dates and formats with brand owners:
Check whether the brand owner or importer has determined that a warning is appropriate based on anticipated chemical exposure.
Record estimated manufacturing and labeling dates to evaluate how production relates to the January 1, 2028 cutoff.
Consider checking consistency between physical packaging graphics and online catalog disclosures.
Buyer Recommendations
Confirm warning responsibility: Ask your client or brand owner who determines chemical exposure and warning decisions.
Track manufacturing timelines: Note production and labeling dates on order records to document when goods were produced.
Review packaging proofs: Check pre-press graphics against the exact wording agreed upon with the brand owner.
Avoid generic supplier templates: Request clear confirmation from the brand compliance team on whether a short-form warning is needed and which version to apply.
